Kelleth Cuthbert, better known as The Fiji Water Girl, has filed a lawsuit against Fiji Water.

Court documents obtained by E! News state Cuthbert is suing the company for the "the unauthorized use of [her] photograph, likeness and identity", following her viral moment at the 2019 Golden Globes, where she drew attention for expertly photobombing celebrity red carpet photos.

The model claims the company used her image as the focal point of a global marketing campaign and that she gave Fiji Water authorisation to use her photos to create cardboard cutouts of herself.

She further claims that she did not "sign away her rights to 'Fiji Water Girl'" as the brand allegedly attempted to get her to agree to, attempting to pressure her into a signing a "fake document" authorising the use of her image.

A spokesperson for Fiji Water has said: "This lawsuit is frivolous and entirely without merit. After the Golden Globes social media moment, we negotiated a generous agreement with Ms. Cuthbert that she blatantly violated.

"We are confident that we will prevail in Court. Throughout our history, we have had a sterling reputation working with talent."
